Terms of Service

Applies to: the LightningVPN apps for Android and Android TV (com.lightning.live), the LightningVPN service, and the website at vpnlightning.com.

1. Agreement to these terms

These Terms of Service ("Terms") are a binding agreement between you and VPN Lightning LLC, registered at 30 N Gould St Ste 41275, Sheridan, WY 82801, United States ("LightningVPN", "we", "us"). They govern your use of our apps, our website and the VPN service (together, the "Service").

By installing the app, tapping I Agree on the onboarding screen, creating an account, continuing as a guest, or using the Service in any other way, you accept these Terms. If you do not accept them, do not use the Service.

Our Privacy Policy at vpnlightning.com/privacy is incorporated into these Terms by reference and explains what we do with your information.

You must be at least 16 years old, or the age of digital consent in your country if it is higher, to use the Service. If you are using the Service on behalf of a company, you confirm you are authorised to bind it to these Terms.

2. What the Service is

LightningVPN is a consumer virtual private network. It encrypts your device's internet traffic and routes it through a server you choose, so that the networks between you and that server cannot read your traffic, and the sites you visit see the server's IP address rather than yours.

Depending on your plan, the Service may include:

  • WireGuard and OpenVPN protocols, with automatic protocol selection;

  • multi hop, routing your traffic through two servers in sequence;

  • split tunnelling, letting you choose which apps bypass the tunnel;

  • anti tracker DNS filtering and custom DNS resolvers;

  • a kill switch, using Android always on VPN, that blocks traffic when the tunnel drops;

  • a dedicated IP address;

  • an Android TV app with device pairing.

Which of these your account can use is determined by your plan, and the app will tell you when a feature is not included. We may add, change or withdraw features. Where a change materially reduces what you have paid for, section 13 applies.

What the Service is not

A VPN is not anonymity, and it is not comprehensive security. You should understand its limits before relying on it:

  • It does not make you anonymous. Sites can still identify you when you log into them, and can profile you through browser fingerprinting, cookies and your own behaviour.

  • It does not protect you from malware, phishing, a compromised device, or an account password you have given away.

  • It does not encrypt traffic after it leaves our exit server toward a site that does not use HTTPS.

  • It cannot guarantee access to any particular website or streaming service. Services that block VPN traffic may block ours, and that is not a defect in the Service.

  • Any tool on your device that reports location independently of your IP address, GPS for example, is unaffected by the VPN.

3. Your account

Creating one

You can create an account with an email address and password, with a one time code sent to your email, by signing in with Google, or with your phone number. You must give accurate information and keep your email address current, since it is how we send verification codes, expiry warnings and security notices.

Guest access

You may explore the app as a guest without giving us an email address. A guest session is tied to your device, and a guest account has reduced functionality: features that require an identified account, including the kill switch, are unavailable, and a guest session cannot be recovered if you lose or reset the device. If you later create an account, you may be able to attach a guest subscription to it.

Keeping it secure

You are responsible for your credentials and for everything done through your account. Tell us at [email protected] immediately if you believe your account has been compromised. We are not liable for losses caused by someone else using your credentials before you tell us, but we will help you regain control.

Do not share your account. It is licensed to you for your own personal use, on the number of devices your plan includes.

Device limits

Each plan allows a set number of simultaneous devices, up to 5 on a paid account, shown in the app under Devices. When you reach the limit, you must sign a device out before adding another. You may remove devices yourself at any time. Circumventing the limit, including by resetting device identifiers to register the same device repeatedly, is a breach of these Terms.

4. Subscriptions, billing and renewal

Sold through Google Play

Subscriptions bought in the Android app are sold and processed by Google Play, not by us. Google's own terms of service and payment terms apply to the transaction alongside these Terms. We never receive your card or bank details.

Auto renewal, read this part

  • Payment is charged to your Google Play account when you confirm the purchase.

  • Your subscription renews automatically at the end of each billing period at the then current price for your plan, unless you cancel at least 24 hours before the period ends.

  • Google charges the renewal within the 24 hours before the current period ends.

  • You cancel through Google Play. Open the Play Store, go to Subscriptions, and cancel LightningVPN there. Deleting the app does not cancel your subscription, and neither does deleting your LightningVPN account. Only Google Play can stop the billing.

  • Cancelling stops future charges. Your access continues until the end of the period you have already paid for.

Prices and changes

Prices are shown in the app in your local currency before you buy, inclusive of any tax Google collects on our behalf. We may change prices for future billing periods. Where a price increase affects your renewal, Google will notify you and, where required, ask you to consent before it takes effect. You can always cancel instead.

Refunds

Refunds for purchases made through Google Play are handled under Google Play's refund policy, and we cannot issue them directly. Request a refund in the Google Play Store, or through Google's support. We will help you with a request where we reasonably can, but the decision is Google's.

Your statutory rights are unaffected. If you live in the UK, EU or EEA you have a 14 day right of withdrawal on digital purchases, though it is lost once supply has begun with your consent. If a Google Play refund is refused in circumstances where your local consumer law entitles you to one, contact us at [email protected] and we will put it right.

Restoring a purchase

If you reinstall the app or move to a new device, use Restore Purchase to reattach your existing subscription. We verify it with Google before restoring your entitlement, so it may take a moment.

Expiry

When a subscription lapses, your account reverts to a state with no VPN access, and the features your plan unlocked stop working. Your account record and settings are retained so that renewing restores everything.

5. Acceptable use

The Service exists to protect lawful private communication. You agree not to use it to:

  1. break any law that applies to you, or to help anyone else break one;

  2. attack, disrupt, overload, probe or gain unauthorised access to any network, system, account or device, including port scanning, denial of service attacks, credential stuffing, exploit delivery and botnet command and control;

  3. send spam, bulk unsolicited messaging, or operate open relays or proxies;

  4. transmit, store or distribute child sexual abuse material, which we report to the authorities without exception;

  5. harass, stalk, threaten, defame or incite violence against anyone;

  6. infringe copyright, trademarks, patents, trade secrets or other intellectual property;

  7. commit fraud, run phishing operations, or trade in stolen credentials or payment data;

  8. resell, sublicense, rent or commercially redistribute the Service, or provide it onward as your own product, without our written agreement;

  9. share, sell or otherwise transfer your account credentials;

  10. run servers or services for third parties on top of your connection, or use a consumer plan as commercial transit;

  11. reverse engineer, decompile or tamper with our proprietary components, except where such a restriction is void under law that applies to you or where an open source licence in section 9 grants you that right;

  12. interfere with our network's operation, evade device limits or bandwidth management measures, or abuse trials, promotions or referral schemes;

  13. use automated means to create accounts in bulk.

Because we keep no activity logs, we usually cannot see a breach directly. We act on credible reports from network operators, abuse complaints and payment fraud signals.

Consequences. Where we have a reasonable basis to believe you have breached this section, we may suspend or terminate your account, refuse service in future, and, where the law requires it, cooperate with the authorities. For a serious breach we may act without notice. Section 4's refund position is unchanged by a termination for breach: we do not refund the remainder of a period on an account closed for abuse.

Fair use

We do not impose artificial speed caps or data allowances on paid plans. We do reserve the right to manage the network proportionately where a single account's usage degrades the service for others, and to contact you first where circumstances allow.

6. Your device, your network, your responsibility

  • You need a compatible Android device, Android 6.0 or API 23 and later, and your own internet connection. Data charges from your mobile operator are yours to pay, and a VPN adds a small amount of protocol overhead to the data you use.

  • Android requires you to grant a VPN permission before any VPN app can create a tunnel. You may revoke it at any time in your system settings, which disconnects the Service.

  • Only one VPN can be active on Android at a time. Turning ours on displaces another, and the reverse is also true.

  • The kill switch relies on Android's always on VPN feature, which you enable in system settings. Its behaviour is determined by your version of Android, not by us, and some manufacturers' battery optimisation features can interfere with keeping a tunnel up. We cannot guarantee the tunnel never drops.

  • Features that depend on Google Play Services, meaning Google sign in, SMS code retrieval, push notifications, in app purchases and in app updates, will not work on devices without them.

  • Check the law where you are. VPN use is restricted or illegal in some countries. It is your responsibility to know whether you may lawfully use the Service where you are, and we do not encourage anyone to break the law of their own country.

7. Service availability

We work to keep the Service available and fast, but we do not promise uninterrupted service. Servers go down for maintenance, capacity shifts, networks between you and us fail, and we sometimes withdraw a location entirely, because a data centre closes, a provider changes, or operating there stops being compatible with protecting our users. A particular server, country, protocol or IP address is not guaranteed, and its removal is not a breach of these Terms.

We do not offer a service level agreement or uptime credits on consumer plans.

8. Our intellectual property, and your licence to use the app

The LightningVPN name, logo, apps, website, designs and server infrastructure are owned by us or our licensors. We grant you a personal, limited, non exclusive, non transferable, revocable licence to install and use the app on devices you own or control, for your own non commercial use, for as long as you comply with these Terms. That licence gives you no other rights, and nothing in these Terms transfers ownership of anything to you.

You may not use our name or logo to suggest we endorse you or your product without our written permission.

If you send us feedback, ideas or bug reports, you grant us a perpetual, worldwide, royalty free licence to use them to improve the Service. We are grateful for them, we do not pay for them, and we are not obliged to act on them.

9. Open source software

The app includes third party open source components, notably the WireGuard and OpenVPN implementations at the heart of the tunnel, and it derives from open source VPN client code. Those components are licensed to you by their own authors under their own licences, including the GNU General Public License, and those licences prevail over these Terms for those components, including any rights they grant you to source code.

10. Disclaimers

To the fullest extent the law allows, the Service is provided "as is" and "as available", and we disclaim all warranties not expressly given in these Terms, including implied warranties of merchantability, fitness for a particular purpose, non infringement, and any warranty that the Service will be uninterrupted, error free, secure, or will achieve any particular result.

Specifically, we do not warrant that the Service will:

  • prevent every form of surveillance, tracking, fingerprinting or traffic analysis;

  • protect a device that is already compromised;

  • grant access to any specific website, app or streaming service, or defeat any specific block;

  • be lawful, or available, in every country.

No advice or information you get from us or from the Service creates a warranty we have not given here.

Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any liability that your local consumer law makes non excludable. If you are a consumer in the UK, EU or EEA, you keep the full benefit of your statutory rights, and nothing here limits them.

11. Limitation of liability

To the extent the law allows:

  • Neither party is liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost revenue, lost business, lost goodwill, or lost or corrupted data, however caused and on any theory of liability, even if warned that such loss was possible.

  • Our total aggregate liability arising out of or relating to the Service or these Terms is limited to the greater of the amount you paid us in the 12 months before the event giving rise to the claim, or USD 50.

  • Where a claim arises from something a third party does, such as Google's billing, a hosting provider's outage, your mobile operator's network, or another user's conduct, we are not liable for it.

These limits apply even if a remedy in these Terms is found to have failed of its essential purpose. They do not apply to the matters listed as non excludable in section 10.

12. Indemnity

You agree to indemnify and hold us harmless against claims, losses, liabilities and reasonable legal costs arising from your breach of these Terms, your misuse of the Service, or your infringement of anyone's rights. This does not apply to the extent the claim arises from our own breach or negligence, and we will not settle any claim in a way that imposes an obligation on you without your consent.

13. Changes to these Terms

We may update these Terms as the Service, the law or our business changes. The "last updated" date above always reflects the current version.

For changes that materially affect your rights or obligations, such as a reduction in what your plan includes, a new restriction on use, or a change to dispute resolution, we will give you at least 30 days' notice by email or in the app before they take effect. If you do not accept the change, you may cancel before it takes effect. Continuing to use the Service after that date means you accept the updated Terms. Minor changes, such as clarifications and corrections, take effect on publication.

14. Suspension, termination and deletion

By you

You may stop using the Service at any time.

  • Cancel the subscription in Google Play to stop billing, as described in section 4.

  • Delete your account in the app under Account, then Delete Account, or at vpnlightning.com/delete-account. Deletion is permanent: your account record, device registrations and settings go, access ends immediately, and we cannot restore any of it.

  • Deleting your account does not cancel a Google Play subscription, and does not by itself entitle you to a refund for the unused remainder of a period.

By us

We may suspend or terminate your access:

  • for a breach of section 5, immediately where the breach is serious;

  • where we are legally required to;

  • if your payment fails or is reversed;

  • if we discontinue the Service altogether, on 30 days' notice, in which case we will refund the unused portion of any prepaid period where the law requires it or through a Google Play refund request where Google permits.

Where we terminate for a reason other than your breach, we will act proportionately and give notice where circumstances allow.

What survives

Sections 8 to 12, covering intellectual property, open source, disclaimers, liability and indemnity, along with section 15 and this section, survive the end of this agreement, together with any payment obligation already incurred.

15. Governing law and jurisdiction

These Terms, and any dispute arising out of them or the Service, are governed by the law of the State of Wyoming, United States, without regard to its conflict of laws rules. The state and federal courts located in Sheridan County, Wyoming have exclusive jurisdiction, and both you and we submit to it.

If you are a consumer in the UK, EU or EEA, or anywhere whose law gives you the same protection, this section does not take away your right to bring proceedings in the courts of the country where you live, or to rely on the mandatory consumer protection law of that country. Nothing in this section overrides a right your local law gives you that cannot be contracted away.

Before filing anything, please write to [email protected]. Most disputes are a misunderstanding, and we would rather resolve yours in a week by email than in a year in court.

16. General

  • Entire agreement. These Terms and the Privacy Policy are the whole agreement between us about the Service, replacing anything said or written beforehand, except that they do not exclude liability for fraudulent misrepresentation.

  • Severability. If a provision is held unenforceable, it is limited or removed to the minimum extent needed and the rest stays in force.

  • No waiver. If we do not enforce a provision, we have not waived it.

  • Assignment. You may not assign these Terms without our consent. We may assign them to an affiliate or an acquirer of the business, on notice to you, provided your rights are not reduced.

  • No third party rights. Nobody other than you and us may enforce these Terms.

  • Force majeure. Neither party is liable for a failure caused by something genuinely outside its reasonable control, such as natural disaster, war, state action, a nationwide network or power failure, or a large scale failure at an infrastructure provider.

  • Notices. We give notice by email to your account address, or in the app. You give notice to [email protected].

  • Language. These Terms are written in English. A translation is provided for convenience only, and the English version prevails if they conflict, except where your local law requires otherwise.

  • Headings are for navigation and carry no legal weight.
