Digital Millennium Copyright Act (DMCA) Policy

1. Introduction

VPN Lightning LLC does not support or permit the use of its service to engage in copyright violations. We follow U.S. copyright laws, including the DMCA, and expect all users to do the same.

VPN Lightning LLC provides an automated virtual private network (VPN) service. The service operates automatically, and we do not record user activity. We do not select or monitor the material accessed by users or the recipients they communicate with while using the service. We do not store, access, or alter any content transmitted through our network.

Therefore, VPN Lightning LLC’s VPN service qualifies as a provider of transitory digital network communications under 17 U.S.C. § 512(a) of the Copyright Act. Because we do not store or log user content, we cannot remove any material that may be infringing. Our commitment to privacy means we cannot identify users who may be violating copyrights.

2. Digital Millennium Copyright Act (DMCA) Takedown Notices

VPN Lightning LLC aims to assist copyright owners and their representatives who report suspected copyright violations involving our services, within our technical limitations. Before we can review any claim, the copyright owner or their authorized representative must submit a valid DMCA takedown notice. If you believe your rights have been infringed by a third party using VPN Lightning LLC’s service, please submit a proper notice to our designated DMCA Agent. If you are uncertain whether content on our network infringes your rights, consult a qualified attorney.

Under 17 U.S.C. § 512(c)(3), a valid DMCA takedown notice must include all of the following details:

– A detailed description of the copyrighted work claimed to have been infringed;
– Identification of the infringing content (each item listed separately);
– Sufficient information to help VPN Lightning LLC locate the material;
– Contact information for the reporting party, including a physical address, phone number, and email address;
– The statement: “I have a good faith belief that the use of the copyrighted materials described above is not authorized by the copyright owner, its agent, or the law.”;
– Identification of the user or party responsible for the alleged infringement;
– The statement: “I swear, under penalty of perjury, that the information contained in this notification is accurate and that I am the copyright owner or am authorized to act on behalf of the owner of the exclusive right allegedly infringed.”;
– A physical or electronic signature of the copyright owner or authorized representative.

Once a DMCA notice is received, VPN Lightning LLC will take reasonable steps to assist if possible, keeping in mind that our network is designed to protect user privacy and does not track individual activity. If a notice fails to meet any of the required elements above, it may be considered invalid, and we will not investigate it.

Under 17 U.S.C. § 512(f), anyone who knowingly provides false information regarding alleged infringement or removal may be held liable for damages, including costs and attorneys’ fees, incurred by the alleged infringer, copyright owner, or service provider affected by the false claim.

3. Counter-Notifications

If we are able to identify a user or third party related to a DMCA complaint, note that VPN Lightning LLC follows the DMCA’s counter-notice process. The DMCA allows those who have been accused of infringement to respond to a takedown notice under 17 U.S.C. §§ 512(g)(2)-(3). Like takedown notices, counter-notifications must meet specific statutory requirements. A valid counter-notification must include:

– Your identifying details, including full name, address, phone number, email address, and a statement consenting to Federal jurisdiction in your local district, agreeing to accept service of process from the party who submitted the original DMCA notice;
– A physical or electronic signature;
– Identification of the content that was removed or disabled (each item listed separately);
– The statement: “I swear, under penalty of perjury, that I have a good faith belief that the material identified above was removed or disabled due to a mistake or misidentification of the material to be blocked.”;

4. Repeat Infringer Policy

VPN Lightning LLC complies with copyright law by removing access to users who repeatedly infringe copyrighted material using our VPN services. If you are a copyright holder or authorized agent aware of repeated infringement involving the VPN Lightning network, please notify us by providing identifying information such as an email address or other user data. If verified as a repeat infringer, the user’s account will be terminated in line with our policy. Accounts terminated for repeated infringement cannot be reinstated or resubscribed.
